Why can’t I trade with a Power of Attorney?

Unfortunately, clients investing under a Power of Attorney are not eligible to invest in Long-Term Asset Funds (LTAFs). While a Power of Attorney grants legal authority to act on someone else’s behalf, LTAFs are subject to strict regulatory requirements. Each person managing an LTAF investment must personally complete an advanced investor self-certification and pass an appropriateness assessment to confirm their understanding of the risks and complexities associated with these funds. Because we cannot reliably verify whether the account holder or the Power of Attorney holder is accessing this account or making investment decisions, particularly in a digital environment, we’re unable to meet these regulatory standards.

Can I self-certify on behalf of the account holder?

No, the self-certification and appropriateness assessment must be completed by the account holder themselves. These steps are designed to ensure that the individual making the investment fully understands the risks and features of Long-Term Asset Funds. Even if you have legal authority to act on their behalf, we’re unable to confirm that the account holder has the required knowledge and experience.

I do not have a Power of Attorney, why am I unable to trade in LTAFs?
